Terms & Conditions

The Client agrees to these Terms & Conditions when making a purchase of any of the Artist’s Work. By purchasing a Work, the Client is purchasing the right, title and interest to the Work only.  This conveyance of right, title and interest in the Work does not include the conveyance of the copyright to the Work, which copyright Artist retains in all respects.  Such copyright includes the right to distribute, reproduce, and create derivative works (including editing, altering or tracing) of the Work and the right to  display the Work other than in its original form or otherwise profit from the display or use of the Work.  The Artist further retains the copyright for any preliminary designs and incidental works made in the creation of the Work.

The Artist is not responsible for any damages made to the Work except for those inflicted at the fault of the Artist or while the Work is in the Artist’s possession. The Artist will contact the Client should this occur. The Artist is also not responsible for any theft or misplacement of the Work The Artist will ensure packaging of the Work is safe and secure up until delivery to the Client’s selected shipping service . The Client accepts all possible risks once payment has been made. If damages have occurred during shipping, the Client must notify the Artist within seven (7) days of receiving the Work, and must provide evidence of said damages to qualify for a refund or an alternative replacement. The Client will have thirty (30) days from the delivery of a damaged Work to the Client to send it back to the Artist.  If the client does not return the Work as set forth herein, no refund or replacement will be provided. The Client must return the Work in its original packaging with all documents, which includes but is not limited to: Stickers, Notes. Postage/shipping costs and expenses for a return will be paid by the Client. A refund will be initiated when the Work has been received and the Artist confirms that it is in the described damaged condition(s). The Artist will refund 50% of the full amount paid back to the Client or such amount as the parties otherwise negotiate. If the Work is stolen, lost, or perished during transit, and never been delivered, the Artist will refund 50% of the full amount back to the Client or as otherwise negotiated. Any damages or misplacement of the Work caused by fault of the Client or while the Work is in Client’s possession will not be refunded or replaced. Disliking the Work or change of mind are not grounds for a refund.

This agreement constitutes the entire understanding between the parties. Its terms can be modified only by an instrument in writing signed by both parties. This agreement shall be governed by the laws of State of Arizona, U.S.A. The Artist has the right to pursue damages under the Copyright Law of the United States should Client breach any of the Terms & Conditions or otherwise infringe Artist’s copyright.
